Car Damage Procedure
In case of accidents which result also in bodily injuries
- Give first aid
- Immediately call 112 to announce the Police and Ambulance Service
- Do not modify the position of the cars involved in the accident and do not remove the traces
- Do not leave the scene of accident without the approval of the Police.
In case of damages occurred while the car was not driven (damage in the parking)
- Notify the damage to the CASCO insurer within the term stipulated in the insurance terms (usually 48 hours)
- Follow the instructions received from the insurer at the claims file opening and / or from the repair shop
- In case of theft of the component parts of the car, you must also notify the Police to issue an assessment protocol to be added to the claims file.
In case of accidents without bodily injuries
- If the car is movable, remove it out from the road and release the scene of the accident. If it cannot be moved (or it has leakages or electric short-circuits), you shall push/tow it outside the road.
- Notify the event to the Police within 24 hours from the accident as well as to the CASCO insurer within the term stipulated in the insurance contract.
- If the Amiable Assessment terms are fulfilled, you can fill in the special form for amiable accident assessment (Formular de constatare amiabila de accident).
In case of theft of the vehicle or of the component parts
- Verify whether the car was towed by the authorities for illegal parking
- Notify the Police about the theft as soon as you discover that the car/component parts of the car are missing,
- Notify the insurer about the theft within the terms stipulated in the insurance contract (the indemnity is granted only if you possess all keys / cards, the registration certificate and the ID card of the vehicle, all in original),
- In case of theft / loss of keys / cards of the vehicle, you must notify in writing the CASCO insurer. You must take measures to replace the locking set (keys / cards), otherwise a possible total theft of the vehicle shall not be indemnified!

Amiable Accident Assessment
As of 1st July 2009 there are in force the norms on the use of the form “Amiable Accident Assessment” according to Order no. 21 / 18.12.2008 of the Financial Supervision Authority published in the Official Gazette, Part I no. 876 from 24.12.2008. Thus for accidents in which two vehicles are involved out of which resulted only material damages, the notification of the insurance companies can also be done based on the Form “Amiable Accident Assessment”.
The Form shall be used for all road accidents occurring on the territory of Romania, further to which only material damages resulted (with no bodily injuries) and in which were involved only two vehicles.
The Form “Amiable Accident Assessment” may be used regardless of the place where the accident occurred: on public roads, on roads that are not opened to the public traffic, within premises and in other places.
The Form “Amiable Accident Assessment” may be used in relation with insurance companies and it shall no longer be necessary to obtain the Police assessment protocol, provided that the Form is filled in and signed by both car drivers involved in the accident. If one of the vehicles is stationed / parked, the Form may be filled in by its owner/user.
Filling in and signing of the “Amiable Accident Assessment” Form does not represent an acceptance of the liability of car drivers, but an accumulation of elements and actions that shall contribute to the claim file settlement.
After filling in, the Form shall be submitted to the insurance companies. The insurance companies shall establish the right for compensations and they shall issue the document for starting the repairs.

Opening of the claim file and performance of the repair
Necessary documents for opening a claim file:
- Power of attorney from the owner of the vehicle (in case of legal entities) or authenticated power of attorney (in case of individual insured persons, if on the protocol / Form is mentioned a person other than the owner)
- The ID card of the person authorized to open the claim file (copy);
- CASCO policy (copy);
- The MTPL (RCA) policy of the vehicle which caused the accident, if the case may be (copy);
- The registration certificate of the damaged vehicle (original and copy);
- The driving license of the person that was driving the vehicle (copy);
- The Form «Amiable Accident Assessment» (original) or Police documents (original), such as Assessment Protocol in case of accident (out of which it should result: the date, place, circumstances of the event, the person responsible for the event, the extent of the damage), the Protocol for evidence of partial/total theft, the Protocol from the Fire Brigade in case of fire.
- Medical certificates issued by the medical authorities that provided first aid after the accident.
Documents issued by insurance company further to claim file opening:
- “Document for repair start” (in case the Form «Amiable Accident Assessment» was used or in case of damages with unknown offender);
- Assessment Protocol comprising: file number, damaged parts, the technical repair solution and the list of necessary documents to complete the claim file;
- The list of repair shops with direct settlement, the recommendation on the repair service according to the vehicle type.
Documents necessary at the repair shop
- Assessment Protocol issued the Insurance Company (original),
- Repair authorization from the Police (copy) or “Document for repair start” issued by the Insurance Company (original),
- Registration certificate (original).
Re-assessments
If, after dismantling of the damaged parts, there are damages that could not be initially assessed, the Insurance Company shall be urgently notified in order to issue an additional protocol for the assessment of such damages, otherwise the additional damages shall not be indemnified.
On completion of the repair operations please proceed as per the following:
- If the repair was performed at a repair shop which has direct settlement agreement with the Insurance Company, the Insured / Lessee shall request the the cost estimate document that will be submitted for approval to the Insurance Company. In order to speed up the Insurer’s approval (payment acceptance) so that the vehicle is released upon finalizing of repair, the final cost estimate document should be requested at least 2 days before completing the repair and submitted to the Insurer together with the Indemnity Application Form (signed and stamped by the owner of the vehicle).
- If the repair was performed at a repair shop which does not have a direct settlement agreement with the Insurance Company, the Insured / Lessee shall pay the repair costs and submit to the Insurance Company the repair invoice (together with the payment confirmation for such invoice) and the Indemnity Application Form (signed and stamped by the owner of the vehicle).
